asked the Secretary of State for Scotland whether he is aware of a decision of the Court of Session in 1926 that a statutory small tenant, dispossessed of his holding by process of resumption in the Land Court, has no claim for compensation for disturbance against the proprietor; and whether he is prepared to introduce legislation so as to confer upon statutory small tenants dispossessed by resumption under Section 32 (10) of the Small Landholders Act, 1911, the same right to compensation for disturbance as has by subsequent legislation been conferred upon ordinary agricultural tenants who have removed from their holdings by reason of notices to quit given by their landlords?

The answer to the first part of the question is in the affirmative. The point will be considered when ever amending legislation is contemplated.
