HC Deb 01 March 1921 vol 138 c1620W
Mr. KELLY

asked the Chief Secretary by whom is the prerogative of mercy now exercised in cases tried by a civil tribunal and cases tried by a military tribunal; and, in view of his statement that he was exercising this prerogative, can he say if there is any departure from the practice by which it has hitherto been exercised by the Lord Lieutenant on the recommendation of the Lord Chancellor?

Mr. HENRY

The exercise of the prerogative of mercy in Ireland rests normally with the Lord Lieutenant who gives his decision after consultation with such of his advisers as he thinks fit to consult. This is the position as regards persons convicted by military as well as civil court except in the martial law area where the military authority is necessarily paramount.
