§ Lord Brabazon of TaraMy Lords, I beg to move that the House do agree with the Commons in their Amendment No. 24. I shall speak also to Amendment No. 31. These amendments are minor technical corrections.
In Scotland a toll order will always authorise the charging of tolls by the roads authority. The order 77 will, however, specify if the right to charge tolls is to be assigned to a private developer. The concessionaire in Scotland will therefore be authorised by an assignation rather than the toll order to charge tolls. It is necessary to remove the words "by a toll order" to ensure that a concessionaire in Scotland is covered by the provisions of Clauses 31 and 37. I commend the amendment to the House.
