60 Clause 25, page 18, line 1, leave out 'satisfied that the case does not fall' and insert 'not satisfied that the case falls'.

My Lords, I beg to move that the House do agree with the Commons in their Amendments Nos. 60 and 61. Amendment No. 60 makes a necessary adjustment to ensure that an application may always be made to a court for a declaration of parentage whenever, without such a declaration, Clause 24 would prevent an assessment being made on the assumption that the person alleged to be a parent was in fact a parent of the child in question.

Amendment No. 61 achieves exactly the same result in respect of Clause 26, which makes corresponding provision in Scotland. I believe that this is an important drafting improvement in both respects and I commend the amendments to your Lordships.
