HL Deb 22 July 1991 vol 531 cc587-8

108 Clause 48, page 32, line 41, after '33', insert 'and paragraph 2B of Schedule 5'.

The Lord Chancellor

My Lords, I beg to move that the House do agree with the Commons in their Amendment No. 108. In moving this amendment, I should like to speak also to Amendments Nos. 131 to 133 and to Amendment No. 135.

These are all technical amendments. Apart from Amendment No. 135, the amendments deal with matters of bankruptcy and provide that child support maintenance will be treated in the same way as court orders for maintenance are now in England and Wales. The amendments for Scotland extend the principles of the existing law on bankruptcy in Scotland to obligations to pay child support maintenance.

Amendment No. 135 adds to the definition of "maintenance order" in Section 106 of the Debtors (Scotland) Act 1987 a maintenance assessment within the meaning of this Bill. I commend the amendments to your Lordships.

Moved, That the House do agree with the Commons in their Amendment No. 108.—(The Lord Chancellor.)

On Question, Motion agreed to.
