188 Schedule 1, page 72, leave out from 'securing' in line 17 to end of line 23 and insert:

  1. '(a) that members of the Board have expertise or knowledge of—
    1. (i) the provision of conveyancing and executry services;
    2. (ii) the financial arrangements connected with the purchase and sale of heritable property;
    3. (iii) consumer affairs; and
    4. (iv) commercial affairs; and
  2. (b) that, so far as is reasonably practicable, the composition of the Board is such as to provide a proper balance between the interests of, on the one hand, qualified conveyancers and executry practitioners and, on the other hand, those who make use of their services.'.

My Lords, I beg to move that the House do agree with the Commons in their Amendment No. 188. This amendment should be welcomed on all sides of the House as it relates to a matter raised in the Bill's consideration here. It has always been the Government's intention that the composition of the board should be balanced between those whom the board is to regulate and those who make use of its services. This amendment will, however, make that commitment crystal clear.
