§ 95 Clause 42, page 35, line 4, at end insert:
- '(12) The Board may—
- (a) pay such remuneration and travelling and other allowances to the Conveyancing Ombudsman as may be determined by the Board;
- (b) pay such pension, allowances or gratuities to or in respect of the Conveyancing Ombudsman as may be so determined; and
- (c) if the Conveyancing Ombudsman ceases to hold office and it appears to the Board that there are special circumstances which make it right that he should receive compensation, pay him such sum as may be so determined.'.
§ The Lord ChancellorMy Lords, I beg to move that the House do agree with the Commons in their Amendment No. 95. I shall speak also to Amendments Nos. 198 to 201.
The amendments, except for Amendment No. 201, deal with remuneration and other expenses of members of the Authorised Conveyancing Practitioners Board and the Conveyancing Ombudsman and his staff.
Amendment No. 201 extends the grounds on which the Conveyancing Ombudsman can make compensation orders to include inconvenience and distress as well as loss. This brings the Conveyancing Ombudsman's powers into line with those of the Legal Services Ombudsman and the Law Society's powers covering inadequate professional services.
