HL Deb 17 July 1986 vol 478 c1074

[References are to [Bill 155] as first printed for the Commons]

1 Clause 4, page 3, line 6, leave out "paragraph 1" and insert "paragraphs 1 and 1A.".

Lord Lucas of Chilworth

My Lords, I beg to move that the House do agree with the Commons in their Amendment No. 1, and with the leave of your Lordships I should also like to speak to Amendment No. 3. Perhaps I should point out that in the first line of Amendment No. 3 the words "name and address" should be "name or address".

Turning to these amendments your Lordships will recall that when this Bill was considered in Committee in this House an amendment in the name of the noble Lord, Lord Lloyd of Kilgerran, removed from Section 1 of the Trade Marks Act 1938 the requirement for the descriptions of proprietors to be entered in the register. Amendment No. 3 is consequential upon Lord Lloyd's amendment.

Section 34 of the 1938 Act, which relates to alteration of the register, also contains a reference to "descriptions", and Amendment No. 3 causes that reference to be omitted. Amendment No. 1 causes the paragraph which is inserted by Amendment No. 3 to extend to the Isle of Man. I beg to move.

Moved, That this House do agree with the Commons in the said amendment.—(Lord Lucas of Chilworth.)

On Question, Motion agreed to.
