HL Deb 23 October 1985 vol 467 cc1146-7

46 [Printed above.]

Lord Lucas of Chilworth

My Lords, I beg to move that this House do agree with the Commons in their Amendment No. 46, to which I have already spoken.

Moved, That the House do agree with the Commons in their Amendment No. 46.—(Lord Lucas of Chilworth.)

Lord Bruce of Donington

My Lords, this amendment seeks to round off the position so far as supervisors are concerned. The Bill itself makes provision for their appointment and for their various duties. The clauses that I put forward tidy it up to provide for what they do when they cease to perform their functions.

For once I am at the mercy of the noble Lord Lord Lucas of Chilworth, because I am not quite sure how we should proceed. With Amendments Nos. 46ZA and 46ZB being superseded by Amendments Nos. 46BZA and 46BAA which have been put down since, I shall ask for the guidance of the noble Lord as to how we should proceed in order to achieve the purpose I have in mind. The noble Lord will be aware that there is this supplementary amendment that has been tabled on the same point which is No. 46BZA. As I understand it the final achievement that we both want is for Amendment No. 46BZA to prevail together with an addition from the noble Lord. As to exactly how we accomplish that, I must confess that I am completely stumped procedurally. I do not know whether I withdraw the original Amendments Nos. 46ZA and 46ZB and then beg to move Amendment No. 46BZA. I am really not quite sure how to proceed. For once I have to throw myself under the noble Lord's protection in order to accomplish the purpose that I have in mind.

Lord Lucas of Chilworth

My Lords, my understanding of this procedural matter is that we should go to Amendments Nos. 46BZA and 46BAA, which is consequential. Therefore, perhaps I may suggest that the noble Lord speaks to those amendments en bloc, in the last analysis the matter being decided on Amendment No. 46BZA. That is how I understand we should proceed.

Lord Bruce of Donington

My Lords, I am grateful to the noble Lord. I am given to understand—I may be entirely wrong—that this is one of the amendments which, in his wisdom, the noble Lord proposes to accept from me. I do not know whether or not that is the case, but it would have a profound effect upon how long I address the House on it. However, I am given to understand that the noble Lord is prepared to accept this amendment. I shall therefore not move Amendments Nos. 46ZA and 46ZB, and beg at the appropriate moment to move Amendment No. 46BZA:
