4 Clause 11, page 7, line 29, leave out ("and").

5 Clause 11, page 7, line 30, at end insert— (": and (c) for the termination of the employment with the authorities concerned of persons to whom the regulations apply (whether or not they are transferred in accordance with the regulations) and as to the consequences of that termination.").

6 Clause 11, page 7, line 35, at end insert ("and may make such modifications in the application of any enactment as the Attorney General considers appropriate in connection with any provision of the regulations of a kind mentioned in subsection (2)(c) above").

My Lords, I beg to move that this House do agree with the Commons in their Amendments Nos. 4 to 6. The amendments are technical and tie up loose ends concerning the existing contracts of staff affected by the transfer regulations. I beg to move.

My Lords, when the Minister says that these are technical amendments, I take it that by that he means that no point of principle arises. I remember one famous occasion in your Lordships' House when some counsel said to the noble and learned Lord, Lord Morris of Borth-y-Gest, that the proposal was raising a mere technical point. The noble and learned Lord said, "Very often, what you think is a technical point is a point of principle that the other side remembered". I am assuming that when the noble Lord says that it is a mere technical point, he means what he says, as he usually does.

My Lords, I am grateful to the noble and learned Lord. I mean that the amendments are technical. If it is any reassurance to the noble and learned Lord, contracts of employment often include provisions as to the notice that must be served before an employee can leave for new employment. These amendments will enable staff to transfer into the new service under the regulations to avoid what in the circumstances may well be inappropriate conditions and, moreover, ones which are impossible to meet.
