Crown Proceedings Act 1947 (c. 44)

1. In section 24(3) of the Crown Proceedings Act 1947 as it applies in Northern Ireland in relation to Her Majesty's Government in the United Kingdom and in relation to Her Majesty's Government in Northern Ireland for the words from the beginning to "damages") there shall be substituted the words "Section 33A of the Judicature (Northern Ireland) Act 1978 and Article 45A of the County Courts (Northern Ireland) Order 1980 (which respectively empower the High Court and county courts to award interest on debts and damages)".

2. In section 31(9)(c) of the Judicature (Northern Ireland) Act 1978 for the words "section 17 of the Law Reform (Miscellaneous Provisions) Act (Northern Ireland) 1937 "there shall be substituted the words" Article 45A of the County Courts (Northern Ireland) Order 1980".

3. In Article 2(4) of the County Courts (Northern Ireland) Order 1980 for the words from "the power" to the end there shall be substituted the words "Article 45A or of anything done under it".").

The noble and learned Lord said: My Lords, this, again is, a Northern Irish amendment, a somewhat long one. The new schedule, together with the new Clause 62A, does for Northern Ireland what Clause 15 and Schedule 1 do for England and Wales; the combined effect is to give the High Court and the county courts in Northern Ireland the same enlarged powers to award interest on debts and damages.

Schedule 7 [Amendments of Judicature (Northern Ireland) Act 1978]:

The Lord Chancellor moved Amendment No. 41: Page 60, line 2, leave out ("out of money provided by Parliament").

The noble and learned Lord said: This is a drafting amendment, my Lords. The words to be omitted are, I am advised, superfluous.

Schedule 8 [Repeals and revocations]:

The Lord Chancellor moved Amendment No. 42: Page 60, line 30, column 3, at end insert— ("Section 17.").

The noble and learned Lord said: My Lords, this removes the existing powers to award interest on debts and damages, since they are replaced by the wider powers conferred on the High Court and county courts of Northern Ireland by the new Clause 62A and the new schedule.
