The Earl of Avon

My Lords, I beg to move that this House doth agree with the Commons in their Amendments Nos. 97, 98 and 99. Clause 37 enables local planning authorities to make management agreements. Subsection (2)(c) enables the agreements to provide for payments by the planning authority to persons concerned, but it has come to light that sometimes this might interfere with the parties' needs and desires. They might sometimes want an agreement under which the landowner or occupier makes some payments to the planning authority. There is no reason to rule this out, and Amendment No. 97 widens subsection (2)(c) so that it is not ruled out. Amendments Nos. 98 and 99 are drafting consequentials.

Moved, That this House doth agree with the Commons in the said amendments.—(The Earl of Avon.)

On Question, Motion agreed to.
