44 Clause 5, page 8, line 11, leave out from 'is' to end of line 13 and insert 'an entitled and a non-entitled spouse, on the entitled spouse ceasing to be an entitled spouse in respect of the matrimonial home to which the order relates; or'.

My Lords, this amendment is very nearly on all fours with the amendments in the first group to which I have already spoken. It not only incorporates the terms "entitled" and "non-entitled", but I should tell the House that it also improves the drafting so that it is clear that the occupancy right ceases only in relation to the specific matrimonial home covered by the court order. I beg to move that the House doth agree with the Commons in their Amendment No. 44.
