HL Deb 14 October 1981 vol 424 c399

122 Page 18, line 33, at end insert, "and in computing the period of two days referred to in paragraph (a) and (b) above, no account shall be taken of a Saturday or Sunday or of any holiday in the court in which the proceedings for breach of interdict will require to be raised.".

The Earl of Mansfield

My Lords, I beg to move that this House doth agree with the Commons in their Amendment No. 122. The purpose of this amendment is to make it clear that the two days referred to in the clause refer to two court days, excluding weekends and court holidays. Otherwise the position might be that the arrested spouse might be liberated before there was an opportunity to hear the other spouse's action for breach of interdict. The essential purpose of the further detention would be to protect the applicant spouse from molestation or anxiety in the period from the arrest to the hearing of the action.

Moved, That this House doth agree with the Commons in the said amendment.—(The Earl of Mansfield.)

On Question, Motion agreed to.
