58 Page 9, line 22, at end insert, 'or (e) the dealing comprises the purchase of a matrimonial home by a third party who has acted in good faith, if, at the time of the dealing, there is produced to the third party by the entitled spouse—

  1. (i) an affidavit sworn or affirmed by the entitled spouse declaring that there is no non-entitled spouse; or
  2. (ii) a renunciation of occupancy rights or consent 390 to the dealing which bears to have been properly made or given by the non-entitled spouse.'.

The Earl of Mansfield

My Lords, I beg to move that this House doth agree with the Commons in their Amendment No. 58, to which I have already spoken on Amendment No. 55.

Moved, That this House doth agree with the Commons in the said amendment.—(The Earl of Mansfield.)

Lord Drumalbyn

My Lords, may I ask my noble friend one question? It relates to subparagraph (ii). I am not familiar with the word "bears". Is it legal jargon or a misprint, and if it is legal jargon, what does it mean?

The Earl of Mansfield

My Lords, it is a good Scottish word. It is neither a misprint, nor jargon, legal or otherwise. It means, if I may educate my noble friend without giving him offence, "in all respects appears to".

Lord Drumalbyn

My Lords, I am much obliged to my noble friend.

On Question, Motion agreed to.
