1871§ The Earl of MANSFIELDMy Lords, I beg to move that this House doth agree with the Commons in their Amendment No. 107. This amendment extends the range of matters which may be dealt with by certificate evidence to include certain specific offences under the Immigration Act 1971. Proof of these offences requires, inter alio, factual information relating to the accused's date and place of arrival; the conditions attached to any leave to enter; any subsequent variation of these conditions; and the date on, and method by which, the accused was given notice of any leave to remain.
Under current Scottish law the presence of two persons is required in court to speak on such matters. A certificate under Schedule 1 to the Bill would simplify the procedures and considerably reduce the administrative burden of sending officers to court to give purely factual evidence.
