§ The Earl of MANSFIELDMy Lords, I beg to move that this House doth agree with the Commons in their Amendment No. 81. The purpose of this amendment is to clarify the drafting of Clause 49. It makes clear that where an offender pays part of his fine and defaults in the remainder, and no period of imprisonment in default has been specified, the offender is liable to a maximum period of imprisonment determined by reference to the table in new Section 407(1A). As drafted, subsection (1D) could be read as implying that this maximum period was to be imposed in every case.
