Interpretation

8. In this Part of this Schedule " the repeal date " means the day on which, by virtue of subsection (2) of section (Replacement of provisions of Part III of Medical Act 1956) of this Act, sections 18 to 24 and 26 of the Medical Act 1956 are repealed.

Fully registered Commonwealth or foreign practitioners

9. Where a person is, immediately before the repeal date, registered under section 18 of the Medical Act 1956

  1. (a) he shall, on and after that day, be treated as having been registered under section (Full registration by virtue of recognised overseas qualifications) of this Act as a fully registered medical practitioner; and
  2. (b) any qualifications of his registered under section 18 of that Act shall, on and after that day, be treated as having been registered under section (Full registration by virtue of recognised overseas qualifications) of this Act as if they were recognised overseas qualifications.

Provisionally registered Commonwealth or foreign practitioners

10. Sections 22 and 23 of the Medical Act 1956 shall, notwithstanding their repeal on the repeal date, continue to have effect on and after that day in relation to persons Nn ho were registered under section 23 immediately before the repeal; and a person who was so registered shall, on satisfying the General Council of the matters specified in paragraph (a), (b) or (c) of section 22(2), be entitled to be registered under section (Full registration by virtue of recognised overseas qualifications) of this Act as a fully registered medical practitioner and to have registered thereunder as if they were recognised overseas qualifications any qualifications which he would have been entitled to have had registered under section 18 of that Act.

Pending appeals etc. against refusal of registration.

11. Section 24 of the Medical Act 1956 shall, notwithstanding its repeal on the repeat date, continue to have effect on and after that day for the purposes of the disposal of any appeal under that section; and where in consequence of a direction given under that section on the determination of an appeal disposed of by virtue of this paragraph a person would, but for the repeal of section 18 or 23 of that Act, be entitled to be registered under the said section 18 or 23 he shall—

  1. (a) if he would have been entitled to be registered under section 18 of that Act be entitled to be registered under section (Full registration by virtue of recognised overseas qualifications) of this Act as a fully registered medical practitioner and to have registered thereunder as if they were recognised overseas qualifications any qualifications which he would have been entitled to have registered under section 18 of that Act;
  2. (b) if he would have been entitled to be registered under section 23, be treated for the purposes of paragraph 10 above as having been registered under section 23 immediately before its repeal.

12. Section 26 of the Medical Act 1956 shall, notwithstanding its repeal on the repeal date, continue to have effect on and after that day for the purposes of the disposal of any application made under that section; and where an order is made under that section on the completion of the consideration of an application by virtue of this paragraph, a person who would, but for the repeal of section 18 of that Act, be entitled in consequence of the order to be registered under that section shall be entitled to be registered under section (Full registration by virtue of recognised overseas qualifications) of this Act as a fully registered medical practitioner and to have registered thereunder as if they were recognised overseas qualifications any qualifications which he would have been entitled to have registered under section 18 of that Act.

Persons registered under the Medical Practitioners and Pharmacists Act 1947

13. Any person registered as a Commonwealth practitioner or as a foreign practitioner by virtue of section 1 of the Medical Practitioners and Pharmacists Act 1947 at any time between the end of 1956 and the repeal of that Act by section (Replacement of provisions of Part III of Medical Act 1956) of this Act shall, if his registration is in force immediately before the repeal, be treated on and after the repeal as registered under section (Full registration by virtue of recognised overseas qualifications) of this Act as a fully registered medical practitioner.
