The Commons disagreed to the above Amendment but proposed the following Amendments in lieu thereof:

101 Page 48, line 34, at end insert ("Insulation of nearby buildings from noise and vibration attributable to the use of aerodromes.")

102 Page 61, column 2, leave out lines 32 to 41 and insert("Not included, except so far as relating to the insulation of buildings near aerodromes against aircraft noise and vibration and except for

  1. (a) the matters dealt with in sections 30 to 32; and
  2. (b) those dealt with in sections6 to 11, 13, 14, 16 to 20, 34 and36, so far as relating to the operation of aerodromes.").

My Lords, I beg to move that this House doth not insist on their Amendment No. 100, to which the Commons have disagreed, and doth agree with the Commons in their Amendments Nos. 101 and 102—to the words so restored to the Bill.

I have earlier explained that it is the Government's policy that the Scottish Administration should have no powers in relation to the control of noise pollution or vibration caused by aircraft using aerodromes. It is, however, our intention that the Assembly should have powers to mitigate the effects of noise by the insulation of buildings near aerodromes. Amendments Nos. 101 and 102 are technically better in achieving this result than the original wording.

Moved, That this House doth not insist on their Amendment No. 100, to which the Commons have disagreed, and doth agree with the Commons in their Amendments Nos. 101 and 102 in lieu thereof.—(Lord Kirkhill.)
