HL Deb 15 November 1976 vol 377 c1005

22 Clause 5, page 5, line 30, leave out "the cargo-handling zone" and insert "a definable dock area"

The Commons disagreed to this Amendment for the following Reason:

23 Because they would exclude areas within which owrk should be capable of being considered for classification.

Lord JACQUES

My Lords, I beg to move that this House doth not insist on their Amendment No. 22, to which the Commons have disagreed for Reason No. 23. Before the Question is put, there are two things that I should say. First, I wish to put forward in place of the Amendment which has been rejected by the Commons the Amendment on the supplementary Marshalled List, in:

Page 5, line 28, leave out subsection (4) and insert: (4) The work that may be classified is any which—

  1. (a) is done or to be done at premises in a definable dock area and is within Part I of Schedule 3 to this Act and not within Part II of that Schedule; or
  2. (b) whether or not falling within paragraph (a) above, is reported by the Board to the Secretary of State under section 6 below as having been dock work for the purposes of the 1967 Scheme or been to treated by custom and practice".)

Secondly, I should mention that in the second last line of the typescript the word "to" should be deleted and the word "so" put in its place.

Moved, That the House doth not insist on the said Amendment to which the Commons have disagreed for the Reason numbered 23, but agree to the Amendment in lieu thereof as set out on the Manuscript List subject to the Amendment to delete "to" and insert "so" in the penultimate line.—(Lord Jacques.)

On Question, Motion agreed to.
