Schedule 1, page 22, line 14, leave out from ("section 126") to end of line 40 and insert ("omit the words from "and the instrument is registered" to the end of the subsection in subsection (1) and after subsection (4) insert—
'(4A) In relation to a covenant falling within subsection (2) above, section 1(1)(d) of the Local Land Charges Act 1975 shall have effect as if the reference to the commencement of that Act were a reference to the coming into operation of this section.'")
§ The LORD CHANCELLORMy Lords, I beg to move that this House doth agree with the Commons in their Amendment No. 8. This Amendment aligns covenants made under Section 126 of the Housing Act 1974 with the general regime of the Bill, by making them local land charges falling under Clause 1(1)(d). The Amendment also inserts a new subsection (4A), providing that these covenants, even where made before the coming into operation of the Bill are local land charges under Clause 1(1)(d). I beg to move.
