My Lords, I beg to move that this House doth agree with the Commons in their Amendment No. 6. This Amendment is for the avoidance of doubt. It makes it clear that Clause 10(6) (which restricts the right of registering and originating authorities to recover from third parties compensation paid under the clause) does not preclude the right of those authorities to recover by way of damages for fraud any amounts paid by way of compensation. The Amendment meets a point which was raised by Mr. Graham Page in another place. Although it is considered that Clause 10(6) as it stands would not preclude proceedings for fraud, the Amendment makes this abundantly clear. I beg to move.
