[Nos. 38–42] Clause 16, page 18, line 39, leave out from "day" to "and" in line 41 and insert:

  1. "(i) was held by a local authority solely for the purposes of one or more of its health functions, or
  2. (ii) was held by a local authority otherwise than as mentioned in the preceding subparagraph and was used by the authority wholly or mainly for the purposes there mentioned;".

Clause 16, page 19. line 5, leave out from "day" to "but" in line 7 and insert:

  1. "(i) been held by a local authority as mentioned in paragraph (a)(i) of the preceding subsection, or
  2. (ii) been held and used by a local authority as mentioned in paragraph (a)(ii) of that subsection,".

Clause 16, line 9, after "held" insert "or, as the case may be, held and used".

Clause 16, line 11, after "held," insert "or held and used".

Clause 16, line 17, after "held" insert "or held and used".

My Lords, with your Lordships' permission, I should like to move Amendments Nos. 38, 39, 40, 41 and 42 together. These Amendments reflect no change in policy as to the transfer of local authority property but are designed to correct a drafting defect. I beg to move.
