[No. 15]
Schedule 4, page 23, line 41, column 3, leave out "and subsection 8".
§ THE LORD CHANCELLORMy Lords, this is a drafting Amendment to the repeal Schedule. The Amendment saves subsection (8) of Section 15 of the Justices of the Peace Act 1949. That subsection preserves rules of court made under the powers repealed by the 1949 Act, which contains in Section 15 a general power to make rules of procedure for magistrates' courts. It was originally proposed to repeal subsection (8) as obsolete, but it was subsequently realised that it supports some seven sets of rules made before 1949: one example is the 807 Moneylenders (Summary Jurisdiction) Rules 1927. I beg to move.
§ Moved, That this House doth agree with the Commons in the said Amendment.—(The Lord Chancellor.)
§ On Question, Motion agreed to.
