HL Deb 08 July 1971 vol 321 c1057

[References are the first Commons' print—Bill 154]

[Nos. 1 and 2]

Clause 1, page 1, line 18, at end insert— (3) An offence committed under this section by destroying or damaging property by fire shall be charged as arson. Clause 4, page 2, line 14, leave out from "of" to "shall" in line 16 and insert "arson under section 1 above or of an offence under section 1(2) above (whether arson or not)".

THE LORD CHANCELLOR

My Lords, I beg to move that this House cloth agree with the Commons in their Amendments Nos. 1 and 2. These Amendments restore the separate name of "arson" which we discussed in our House. The Government, in deference to the opinion of the two branches of the legal profession, moved Amendment No. 1 in another place. Although my preference was for the Bill as it was originally drafted, my advice to the House is that these Amendments should be accepted. They will give a great deal of pleasure to the legal profession.

Moved, That this House doth agree with the Commons in the said Amendments.—(The Lord Chancellor.)

LORD GARDINER

My Lords, I have read the proceedings before the Standing Committee in another place and, following the words of the noble and learned Lord the Lord Chancellor, I advise my noble friends to accept this Amendment.

On Question, Motion agreed to.
