HL Deb 22 April 1971 vol 317 cc858-9

[No. 98]

Schedule 8, page 70, line 29, at end insert —

"Criminal Appeal Act 1966

. In section 1(3) of the Criminal Appeal Act 1966 the words 'of the Queen's Bench Division' and paragraph (a) shall be omitted.

THE LORD CHANCELLOR

My Lords, I beg to move that this House cloth agree with the Commons in their Amendment No. 98. This Amendment is small but contains one point of substance. It will enable any judge of the High Court to sit in the Criminal Division of the Court of Appeal at the request of the Lord Chief Justice. At the moment the Court consists, I think, merely of Queen's Bench Judges, apart from the Lords Justices. Many of the judges, for instance, in the Probate, Divorce and Admiralty, are well qualified to sit in the Criminal Division of the Court of Appeal, and I think that your Lordships will agree that this small Amendment will be of some use to the Lord Chief Justice when planning sittings in the Criminal Division of the Court of Appeal. I beg to move.

Moved, That this House doth agree with the Commons in the said Amendment.—(The Lord Chancellor.)

LORD GARDINER

My Lords, I agree with this Amendment. I rose only to say that the remaining Amendments do not seem to me to raise any matter which should take up the time of your Lordships' House; and if the noble and learned Lord the Lord Chancellor chooses to take them en bloc, I should respectfully offer no objection.

THE LORD CHANCELLOR

My Lords, I am very much obliged to the noble and learned Lord. I will put this Amendment separately and the rest en bloc.

On Question, Motion agreed to.
