[Nos. 32 and 33]

Clause 47, page 32, line 40, leave out "and giving evidence".

Page 33, line 3, leave out "and giving evidence".

THE LORD CHANCELLOR

My Lords, I beg to move that this House Both agree with the Commons in their Amendments Nos. 32 and 33, with which I should like to take, if I may, Amendment No. 55. The purpose of these Amendments is to remove any doubt that a witness who attends at the request of the court or either party, but who is not subsequently required to give evidence, shall qualify for payment of witness fees and expenses. These Amendments bring the provisions of the Bill into line with those of Section 26 of the Criminal Appeal Act 1968 and amend the Costs in Criminal Cases Act 1952 to the same effect, I beg to move.

Moved, That this House doth agree with the Commons in the said Amendments.—(The Lord Chancellor.)

On Question, Motion agreed to.
