§ THE LORD CHANCELLORMy Lords, I beg to move that this House doth agree with the Commons in their Amendment No. 5. May I also speak to Amendment No. 14, which is really the same point. I am taking these Amendments rather shortly, but if any noble Lord would like me to explain any of them I shall be most happy to do so. I propose now to state what is the effect of these Amendments. This Amendment omits from Clause 9 the provision in subsection (10) which entitles a would-be applicant for a variation order after the death of the payer to be treated for the purposes of Section 162(1) of the Judicature Act as a person "interested in the estate" of the deceased person. The provision has been omitted not because it was wrong, but because it was found to be already provided for in existing legislation. As I have said, Amendment No. 14 is virtually the same point. I beg to move.
