HL Deb 19 May 1970 vol 310 c998

[No. 7]

Clause 10, page 8, line 2, at end insert— or (c) an order of any court which is enforceable as if it were for the payment of money so recoverable.

THE LORD CHANCELLOR

My Lords, we now come to Part II, the abolition of imprisonment for debt and the creation of attachment of earnings orders. I beg to move that this House doth agree with the Commons in their Amendment No. 7. This, first, is a minor drafting Amendment. The definition of "judgment debt" in this clause includes an order made in the magistrates' courts for the payment of money recoverable as a civil debt. It is not certain that an order of any court which is enforceable as if it were for the payment of money so recoverable would be covered by this definition. This Amendment puts the matter beyond doubt.

Moved, That this House doth agree with the Commons in the said Amendment.—[The Lord Chancellor.)

On Question, Motion agreed to.
