HL Deb 21 October 1969 vol 304 cc1693-4

Clause 23, page 12, line 42, leave out "and" to end of line 8 on page 13 and insert "where the purchase of the estate or interest in question has incurred expenditure for the purpose—

  1. (a) of securing that the estate or interest is no longer affected by the registered land charge or is so affected to a less extent; or
  2. (b) of obtaining compensation under this section;
the amount of the compensation shall include the amount of the expenditure (so far as it would not otherwise fall to be treated as compensation for loss) reasonably incurred by the purchaser for that purpose ".

6.33 p.m.

THE LORD CHANCELLOR

My Lords, this is a purely drafting Amendment designed to emphasise that an award of compensation under Clause 23 must include both any expenditure incurred in seeking to relieve the land of the land charge, and any expenditure incurred in applying to the Chief Land Registrar for compensation. It simply alters the construction of the paragraph to make it clear. My Lords, I beg to move.

Moved, That this House doth agree with the Commons in their Amendment No. 16.—(The Lord Chancellor.)

On Question, Motion agreed to.
