HL Deb 23 May 1968 vol 292 c878

[No. 22]

Page 16, line 20, at end insert— (7) Nothing in this section shall be taken to compel the production by a solicitor of a document containing a privileged communication made by or to him in that capacity or to authorise the taking of possession of any such document which is in his possession.")

LORD WINTERBOTTOM

My Lords, I beg to move that the House doth agree with the Commons in Amendment No. 22. The purpose of this Amendment is to preserve the traditional privilege which applies to communications made by or to solicitors in their professional capacity. It ensures that the powers conferred on authorised enforcement officers by Clause 27 cannot be used either to compel a solicitor to produce a privileged communication or to seize such a document.

Moved, That this House doth agree with the Commons in the said Amendment.—(Lord Winterbottom.)

On Question, Motion agreed to.
