LORD WINTERBOTTOM

My Lords, with the leave of the House, I beg to move that this House doth agree with the Commons in their Amendments Nos. 19 and 20. These two Amendments are linked and could conveniently be taken together. They make a necessary change in the wording of Clause 27(5) in order to permit the disclosure by one local weights and measures authority to another of information obtained in pursuance of the Bill. The original wording would have prevented authorities from exchanging such information among themselves, because the disclosure would not have been in the performance of their duty—their duty being confined to enforcement in their own area. The Amendments would remove the obstacle to this obviously desirable co-operation among enforcing authorities by permitting officers to pass on information in or for the performance by him or any other person of functions under this Act". I can assure your Lordships that the only respect in which this goes further than the present provision is in permitting disclosure to other enforcing authorities under the Bill.

Moved, That this House doth agree with the Commons in the said Amendments.—(Lord Winterbottom.)

On Question, Motion agreed to.
