My Lords, these Regulations are supplementary to the Material Development Regulations 1967 which define "material development" for the purposes of the Land Commission Act. The definition is needed for the acquisition of land under Part II of the Act, since the Commission's power to acquire land operates only where land is suitable, in their opinion, for material development. It is also necessary for the assessment of the levy under Part III of the Act, since in the assessment of current use value it has to be assumed that planning permission would be granted only for development which does not constitute material development. The Regulations are due to come into force on August 1. They make two amendments to the definition in the main Regulations of development which is not material development. The effect of both these amendments is in favour of the subject; they reduce liability to betterment levy. I beg to move.
