Clause 6 [Retiring age]:

THE MINISTER OF STATE, SCOTTISH OFFICE (LORD CRAIGTON)

This is a drafting Amendment which achieves the original intention of Section 6 (2). The intention was that the retiring age of 72 should apply only to part-time sheriffs who are first appointed as such after the date of enactment. But every sheriff is subject to a separate appointment, and so, unless the word "appointed" is altered, the effect of the Bill would be that if one of the present part-time sheriffs moved to another part-time sheriffdom he would in fact be appointed to it after the passing of the Act and would have to retire at 72, which was not the intention. I beg to move.
