HL Deb 01 August 1961 vol 234 cc95-6

Clause 72, page 53, line 18, at end insert ("and this section shall not apply to premises situated within the jurisdiction of a harbour authority (as defined in section twenty-three of the Petroleum (Consolidation) Act, 1928)")

Clause 72, page 53, line 20, leave out ("Petroleum (Consolidation) Act. 1928") and insert ("said Act of 1928")

My Lords, I beg to move that this House doth agree with Commons Amendment No. 31, and may I, with your permission, include also No. 32? This clause provides local authorities with powers to deal with petroleum storage tanks which are no longer in use so that they may be made safe. The purpose of this Amendment is to avoid any overlap of jurisdiction in areas for which dock and harbour authorities are responsible. Those bodies are the licensing authorities under the Petroleum (Consolidation) Act, 1928, for dock and harbour areas, and it is clearly desirable that they, rather than the local authorities, should deal with this particular problem in their own areas. I beg to move.

Moved, That this House doth agree with the Commons in the said Amendments.—(Lord Brecon.)

On Question, Motion agreed to.
