Clause 46, page 35, line 17, at end insert— ("(3) This section shall not authorise the execution of any such works as are mentioned in paragraph (a) or (b) of subsection (1) of section three hundred and seven of the Highways Act, 1959 (which relates to dock, harbour and canal undertakings), except with the consent of the undertakers concerned (as defined in that section).")

My Lords, I beg to move that this House doth agree with the Commons Amendment No. 11. The purpose of this Amendment is simply to give to harbour authorities a degree of protection similar to that which they have in regard to works carried out by a local authority under Section 204 of the Highways Act, 1959. The purposes of that section are closely akin to the purposes of this clause, and it is desirable that there should be the same sort of limitation on the powers of local authorities in harbour areas in each provision.
