Clause 9, page 5, line 38, at end insert ("and in the case of a second or subsequent conviction to a fine not exceeding one hundred pounds or to imprisonment for a term not exceeeding three months or to both such fine and imprisonment").

My Lords, Clause 9 at present provides for a penalty of £50 for failure to comply with the requirements of a control scheme. This Amendment adds the penalty of £100 and/or three months imprisonment for a second or subsequent conviction. Although in case of default the Commission will, under Clause 10, be able to carry out the work themselves and charge the owner or occupier, it is felt that if the defaulter fails year after year to carry out a requirement he will be imposing a heavy strain on the Commission's staff and equipment. The heavier penalties should deter defaulters from repeating their offences. Most of the credit for this Amendment. I believe, must go to the noble Lords, Lord Greenhill and Lord Mathers. I beg to move that this House doth agree with the Commons in the said Amendment.
