HL Deb 27 July 1949 vol 164 cc570-1

Clause 6, page 4, line 14, after ("eight") insert ("or of proceedings under sections eleven and twenty-six")

Clause 6, page 4, line 14, leave out ("or otherwise").

LORD LUCAS OF CHILWORTH

My Lords, both these Amendments limit the operation of the section to cases in which the relevant prior patent likely to be infringed is brought to light, either by the official search or by opposition or revocation proceedings before the comptroller. In other words, by these two Amendments we entirely omit what might be called the common informer. I beg to move that this House do agree with the Commons in the said Amendments.

Moved, That this House do agree with the Commons in the said Amendments.—(Lord Lucas of Chilworth.)

On Question, Motion agreed to.
