HL Deb 30 June 1948 vol 157 c99

Clause 18, page 13, line 38, leave out from ("recover,") to end of line 39 and insert ("from any parent of the child any expenses incurred by them under the said subsection (1) and not reimbursed under subsection (5) of section twenty-two of the National Insurance Act, 1946 (which enables payments to be made to local authorities out of the National Insurance Fund in respect of the cost of burial or cremation of certain persons).")

THE LORD CHANCELLOR

My Lords, Clause 18 empowers a local authority to cause to be buried or cremated the body of a child who dies while in their care, and enables the authority to recover any expenditure from any parent of a child who died while under the age of sixteen. The Amendment provides that an authority should not have power to recover expenses from a parent, if the authority has already been reimbursed out of the National Insurance Fund. I beg to move.

Moved, That this House do agree with the Commons in the said Amendment.—(The Lord Chancellor.)

On Question, Motion agreed to.
