HL Deb 26 May 1938 vol 109 c601

Clause 6, page 6, line 6, leave out from ("the") to ("in") in line 7 and insert ("disclosure contained")

LORD TEMPLEMORE

My Lords, Clause 6 provides that, in comparing an invention for which priority of date is claimed in this country under the Convention with the invention for which a patent was first applied for in a foreign country, regard shall be had to the invention disclosed, whether formally claimed or not, in the whole of the relevant foreign documents. The Amendment proposes to provide instead that regard shall be had to the "disclosure contained" in the whole of those documents—wording which it is thought may better represent the intention, and meet a criticism by the noble Lord, Lord Strabolgi, when the Bill was before this House. I beg to move that this House doth agree with the Commons in the said Amendment.

Moved, That this House doth agree with the Commons in the said Amendment.—(Lord Templemore.)

On Question, Motion agreed to.
