HL Deb 17 May 1938 vol 109 cc28-9

Clause II, page 5, line 42, leave out ("unless and until the contrary be proved").

LORD STRATHCONA AND MOUNT ROYAL

My Lords, this is the last Amendment with which we have to deal. Further consideration of this clause has suggested that these words are redundant and should be omitted. "Probative" means "valid and genuine, unless and until the contrary be proved," so that the words proposed to be left out are merely duplication and as such liable to lead to undesirable doubts as to the meaning of the clause itself and of the word "probative" in other Acts. I beg to move that the Amendment be agreed to.

Moved, That this House doth agree with the Commons in the said Amendment.—(Lord Strathcona and Mount Royal.)

On Question, Motion agreed to.
