Clause 3, page 3, line 7, at end insert ("to the extent to which")

Clause 3, page 3, line 8, leave out ("to the inherent capability of the trade mark to distinguish") and insert ("the trade mark is inherently capable of distinguishing")

Clause 3, page 3, line 10, leave out ("to the extent to which").

LORD TEMPLEMORE

My Lords, these three Amendments constitute a corresponding group of Amendments to the last group. Their object is the replacement of the word "capability," which would have been new to this provision, by the words "capable of distinguishing" which appear in the Act of 1919. I beg to move that they be agreed to.
