HL Deb 13 July 1937 vol 106 c362

Clause 2, page 2, line 31, at end insert ("to the extent to which").

Clause 2, page 2, line 32, leave, out ("to the inherent adaptability of the trade mark") and insert ("the trade mark is inherently adapted").

Clause 2, page 2, line 34, leave out ("to the extent to which").

LORD TEMPLEMORE

My Lords, these Amendments to Clause 2 are drafting Amendments aimed at replacing the word "adaptability"—which does not appear in this connection in the existing Acts, and would need interpretation—by the expression "adapted to distinguish" which is already in the Acts and has been elucidated by a number of judgments of the Courts. I beg to move that these Amendments be agreed to.

Moved, That this House doth agree with the Commons in the said Amendments.—(Lord Templemore.)

On Question, Motion agreed to.
