§ THE LORD CHANCELLOR (VISCOUNT HAILSHAM)My Lords, I have to move, That the Indictment for felony signed in the Central Criminal Court under the Administration of Justice (Miscellaneous Provisions) Act, 1933, against Edward Southwell, Lord de Clifford, and also the Inquisition found against the said Edward Southwell, Lord de Clifford, upon the oaths of a Coroner's jury, be removed before this House, and that a Writ of Certiorari be issued for that purpose.
Your Lordships will remember that a Committee was appointed during the last Parliament to consider the proper methods of procedure, and their Report, which was adopted, left it for the present Parliament to fix the date for the trial; but obviously I think your Lordships will all wish that a trial which has already unfortunately been delayed should not be kept hanging over Lord de Clifford's head longer than is absolutely necessary. The earliest date at which the Royal Gallery 49 can be made ready for the trial is December 12, and I would suggest to your Lordships that that date be fixed. This Motion is the necessary preliminary in order to start proceedings which will culminate on Thursday of next week. I beg to move.
§ Moved, That the Indictment for felony signed in the Central Criminal Court under the Administration of Justice (Miscellaneous Provisions) Act, 1933, against Edward Southwell, Lord de Clifford, and also the Inquisition found against the said Edward Southwell, Lord de Clifford, upon the oaths of a Coroner's jury, be removed before this House, and that a Writ of Certiorari be issued for that purpose.—(The Lord Chancellor.)
§ On Question, Motion agreed to, and ordered accordingly.
THE CHAIRMAN OF COMMITTEES (THE EARL OF ONSLOW)My Lords, I have to move, That an humble Address be presented to His Majesty to acquaint His Majesty that this House path appointed that the trial of Edward South-well, Lord de Clifford, indicted for felony, do take place on Thursday the 12th day of this instant December; and humbly to desire that His Majesty will be graciously pleased to give orders for the necessary fitting up of the Royal Gallery for the said trial; and also to appoint a Lord High Steward to continue during the said trial. I believe that this Motion is in accordance with precedent on former occasions.
§ Moved accordingly, and, on Question, Motion agreed to: the said Address to be presented to His Majesty by the Lords with White Staves.
