My Lords, this is a little different. Clause 268 transfers, inter alia, the civil functions of the vestry in a borough or urban district to the council of the borough or district. This would include the powers of the vestry under the Burial Acts. Since the Bill was published it has been pointed out that where a burial ground is provided for a part of a parish the powers of the vestry are exercisable by a meeting of the inhabitants of that part of the parish. As the clause is drawn, those functions would remain vested in the meeting of inhabitants. It would be absurd to leave these powers vested in the inhabitants when the powers of the vestry for the whole parish are transferred to the borough or urban district council, and the object of this Amendment is to remedy this defect in the Bill.
