Clause 3, page 2, line 39, leave out from ("at") to end of subsection and insert ("or before the sale of the produce—

  1. (a) the salesman has received from the owner or consignor a direction in writing to the contrary; or
  2. (b) the owner or consignor and the salesman have entered into an agreement in writing to the contrary;
and any such agreement may apply either to a particular consignment or generally to all such consignments as may be specified in the agreement").

My Lords, there is perhaps, a little more substance in the last Amendment on the Paper. The Bill as originally drafted enabled a consignor and salesman to contract out of the Act in respect of any particular consignment, and the Commons have introduced an Amendment, with the approval of duly authorised representatives of the growers of horticultural produce and the commission agents, which will enable the growers and agents to contract generally out of the provisions of the Act if they think fit. The Amendment is to the effect that such contracts can be made in general terms to apply to all consignments and not to one consignment only. I beg to move that the House agrees with this Amendment.
