Clauses 1 to 4 agreed to.

Clause 5:

Donations inter virum et uxorem to be irrevocable.

5. Donationsinter virum et uxoremshall be irrevocable by the donors: Provided that—

  1. (a) this enactment shall not take effect as regards donations made or granted before the passing of this Act until the expiry of one year from and after that date;
  2. (b) this enactment shall not prejudice the rights of creditors of the donor of any such donation in virtue of the provisions of the Act of the Parliament of Scotland, 1621, Cap. 18; and

  4. (c) ally donation completed within a year and day Ii4ore the sequestration of the estates of the donor under the Bankruptcy (Scotland) Act, 1913, or any amending statute, shall be revocable at the instance of the creditors of such donor.

The LORD CHANCELLOR had an Amendment on the Pa per to delete paragraph (b). The noble and learned Lord said: The Amendment which stands in my name on the Pa per is merely drafting, and I formally move.
