§ The LORD CHANCELLOR (The Earl of HALSBURY)My Lords, the object of this Bill is to amend Section 52 of the Act of 1882, which was intended to protect bankers who had received in good faith and without negligence cheques on behalf of their customers. That section was supposed to be a complete protection to bankers, but a recent case in the Courts turned on the point of a banker allowing his customer to draw money before he actually received payment of the cheque, and it was held that he was then collecting it for himself and not for his customer. This Bill provides that—
A banker receives payment of a crossed cheque for a customer within the meaning of section eighty-two of the Bills of Exchange Act, 1882, notwithstanding that he credits his customer's account with the amount of the cheque before receiving payment thereof.Moved, that the Bill be now read 2a—(The Lord Chancellor.)On Question, Bill read 2a (according to order), and committed to a Committee of the whole House on Monday next.
