41. Mr. Mander

asked the Minister of Health whether he is aware of the difficulties caused to householders in Wednesfield by the action of a builder in erecting houses below the level of the road and obstructing a watercourse; and whether he will consider the advisability of giving powers to local authorities to make bylaws preventing the erection of houses below the road level?

Mr. Elliot

My attention had not previously been drawn to this case. The propriety of such a by-law as the hon. Member suggests would have to be determined in the light of local circumstances, and no such by-law has in fact been proposed by the urban district council of Wednesfield.

Mr. Mander

Will the right hon. Gentleman make inquiry from the district council of Wednesfield with regard to this particular difficulty?

Mr. Elliot

I think the initiative lies with the local authority.

Mr. Mander

But is the Minister willing to consider it if they do submit by-laws?

Mr. Elliot

Naturally I should like to see what the proposal is before I give an undertaking.
