answer text

Places of safety are defined in the Mental Health Act 1983 and include hospitals, care homes for mentally disordered persons, police stations, specified local service authority residential accommodation and any other suitable place the occupier of which is willing temporarily to receive the patient.

Specific guidance to police officers on the availability of places of safety in their areas is a local matter. Local partnerships should have established policy or protocols on the use of section 135 and 136 powers and the operation of agreed places of safety in the area, as specified in the Mental Health Act Code of Practice. Decisions on the most appropriate place of safety in individual cases may also be supported by joint police and mental health worker schemes, such as ‘street triage’, where these are in operation.
